A procedure called “simplified” has been established for class action lawsuits by Article L. 423-10 of the Consumer Code. An examination of its conditions and its regime reveals that it is not very different or much simpler than the normal procedure. Two notions that characterize it, those of “known identity” of consumers allowing its implementation and “direct and individual condemnation” of the professional that it authorizes, require vigilance during its implementation to avoid, to the detriment of the professional, any violation of professional secrecy.
