Sustainable finance and the risks of greenwashing

Professor Myriam Roussille was the first to speak to develop the regulatory fundamentals during the morning session of the general secretariat of LA BANQUE POSTALE on “Sustainable Finance and the Risk of Greenwashing“.

Professor Myriam Roussille described the sources and trends of sustainable finance (European Green Deal) before delving into the main regulations (NFRD, Taxonomy, SFDR, delegated acts of MiF II and IDD). Mr. Julien Martinet then took the floor to outline the main litigation risks related to these regulations, greenwashing, and carbon neutrality claims. He highlighted the state of European regulations being prepared on the subject of greenwashing (environmental claims, green claims directive), as well as the increasing willingness of administrative authorities to address these issues (ACPR, AMF).

After a break, the speakers freely shared with the audience in a roundtable discussion. An exchange that allowed for the presentation and discussion of various topics such as the duty of care of companies, cases related to past and ongoing climate litigation, ecological damage, unilateral commitments, the purpose of companies, say on climate, “green” financing of real estate credit, and class actions.
